CLARIFICATION TEXT ON COOKIES

Dear Visitor,

This text has been prepared by Atty. Dr. Davut GÜRSES and Atty. Yaman ÇELİK ("Pacta Law") as the data controller, within the scope of the Communiqué on the Principles and Procedures to be Complied with in Fulfilling the Obligation to Inform under Article 10 of Law No. 6698 on the Protection of Personal Data ("Law").

Pacta Law undertakes to protect the confidentiality of the information it obtains about its visitors in a manner respectful of personal rights, prioritising privacy and security, and within the framework of this "Clarification Text on Cookies".

1. What is a Cookie?

As Pacta Law, we use cookies and certain other similar technologies (all together referred to as "Cookie/Cookies") so that you can benefit from our website and so that our website can function.

Cookies are small text files stored by your browser on your computer or other electronic devices, normally used to collect statistical information and to analyse usage trends or access to an internet address. Cookies cannot be used to run programs or to distribute viruses to your computer. They are used to collect information such as IP addresses, operating system type, browser type and browser language.

2. Types of Cookies and Purposes of Use

2.1. Session cookies: Also called temporary cookies, session cookies are used to ensure the continuity of the session. They are used during the visitors' visit to the website and are temporary cookies that expire after the browser is closed. Their main purpose is to ensure that the website functions properly during your visit.

2.2. Persistent cookies: Persistent cookies are used to increase the functionality of the website and to provide a faster and better service. They are used to remember visitors' preferences and are stored on visitors' devices via browsers until a certain date or until deleted by the user.

2.3. Strictly necessary cookies (mandatory cookies): These are cookies required for our website to function properly and for you to benefit from its features and the services offered. They are used for purposes such as security and authentication, are not used for any marketing purpose and do not identify you. Disabling these cookies may cause all or part of the services and features to become unavailable.

2.4. First-party cookies: These are placed directly on visitors' devices by the website visited. First-party cookies are defined by the website you are browsing and can only be read by that site.

2.5. Third-party cookies: Third-party cookies are defined by other organisations used for different services.

3. Which Cookies Do We Use and For How Long Do We Store Them?

  • Cookie 1a: A cookie necessary for our website to function, used to fulfil an information society service you have requested (logging in). First-party cookie. Stored for the duration of the session.
  • Cookie 1b: A cookie necessary for the web page to function, used to fulfil an information society service you have requested (form filling). First-party cookie. Stored for the duration of the session.
  • Cookie 1c: A cookie necessary for our website to function, used to fulfil an information society service you have requested (remembering privacy preferences). First-party cookie. Stored for 180 days.
  • Cookie 3: Cookies of our advertising partners placed via our website; these are third-party cookies. They are used by our business partners to profile you according to your interests and to show you relevant advertisements. Third-party cookie. Stored for 365 days.
  • Cookie 4: Used to make our website more functional and to personalise it (to remember your preferences, other than your privacy preferences, when you return to the site). First-party cookie. Stored for 90 days.

4. Transfer of Your Personal Data

Within the scope of the purposes stated above, your personal data may be shared with relevant third parties such as our business partners, performance assistants, suppliers, and authorised public institutions and organisations — based on your explicit consent or in the other cases set out in Article 5/2 of the Law — within the framework of the personal data processing conditions and purposes set out in Articles 8 and 9 of the Law.

5. International Transfer of Your Personal Data

Your personal data may be shared with and/or transferred to our service providers in cases where the privacy and data protection laws in your jurisdiction are not sufficiently protective. This is only for cases where it is mandatory for the Services to be provided to you. In order to regulate such data transfers and to guarantee that adequate security measures are taken to protect and maintain data integrity in the event of a transfer, there are specific obligations set out under Chapter V of the GDPR (which we will comply with).

6. Change of Purpose

Your personal data will be used only for the purposes for which it was collected by us. However, if it needs to be used for another purpose and this purpose is compatible with the original purpose, we may use your personal data for such new purposes. 7. How to Disable Cookies and Change Cookie Preferences

It is possible to change cookie settings for the Microsoft Internet Explorer, Google Chrome, Mozilla Firefox, Apple Safari and Opera browsers.

Contact and Your Right to Apply

You can submit your requests and complaints regarding your personal data to us at info@pactahukuk.com, together with information identifying you, in accordance with Article 13 of the KVKK and Article 5 of the Communiqué on the Procedures and Principles of Application to the Data Controller published in the Official Gazette dated 10 March 2018 and numbered 30356.

You may also submit your written applications to the address Koşuyolu Mahallesi Koşuyolu Caddesi No:12/A Koşuyolu Kadıköy İstanbul. Where you submit your requests through these methods, Pacta Law will conclude your request free of charge within thirty days at the latest, depending on its nature. However, if a fee is stipulated by the Personal Data Protection Board, a fee may be charged.
